As of February 22, 2026, New York City has expanded the Earned Safe and Sick Time Act (ESSTA), giving workers more flexibility and support when taking time off.

What’s New?

Workers now receive an extra 32 hours of unpaid safe and sick time each year, in addition to existing paid leave. This time is frontloaded when you start a job and refreshed annually.

How Much Paid Leave Do You Get?

  • 100+ employees at your company: Up to 56 hours of paid leave
  • 5–99 employees: Up to 40 hours of paid leave

You earn paid leave at a rate of 1 hour for every 30 hours worked.

Who Is Covered?

If you work in NYC—full-time, part-time, or temporary—you are covered.

What Can You Use Leave For?

You can use your time off for:

  • Your own health needs or doctor visits
  • Caring for a family member
  • Situations involving domestic violence or emergencies
  • Legal or social services

You also get 20 hours of paid prenatal leave for pregnancy-related care.

What Are Your Rights?

  • Employers can only ask for documentation after 3 consecutive days off
  • You must receive a notice of your rights
  • Your leave balance must appear on your paystub or online system
  • You can take legal action if your rights are violated (within 2 years)
