Jury Awards $2.5 Million in Retaliation Claim

We are pleased to advise our colleagues that following a two week trial in the United States District Court for the Southern District of New York, the jury, after less than an hour's deliberation, returned a verdict in favor of our client on June 9, 2006. The verdict was in the amount of $2.5 million, of which $300,000 was an award of punitive damages. The verdict was based upon a retaliation claim arising from plaintiff's allegation of age discrimination.

Since the action was initially brought under the New York City Law and was removed to federal court, the amount was not subject to the federal cap. An application for legal fees will now be made, which we believe should increase the award.

There is substantial additional information that we believe will be of interest to our colleagues, and which we expect to share at such time as the judgment is entered.

The case was tried by Murray Schwartz, together with his daughter/partner, Davida S. Perry, along with one of our associates, Brian Heller.
